These terms apply to your use of bastionsoftwaresolutions.com (the “Website”) and to purchases of Bastion products. The Website is operated by Bastion Software Solutions Ltd, a company registered in England and Wales under company number 17239067, whose registered office is at 4th Floor, Silverstream House, 45 Fitzroy Street, London W1T 6EB (“Bastion”, “we”, “us”).

1. Who you buy from
1.1 Our online store is operated by FastSpring, our authorised reseller and merchant of record. When you buy a Bastion product, you buy it from FastSpring. FastSpring processes your payment, charges and remits any applicable sales tax or VAT, and issues your invoice or receipt.
1.2 FastSpring’s Terms of Sale govern the payment transaction. They are shown during checkout and available at fastspring.com.
1.3 Your use of the software you buy is governed by our Software Licence Agreement. By installing, activating or using any Bastion product you accept that agreement.
2. Products and prices
2.1 We sell perpetual software licences for Bastion developer libraries (SDKs) and applications. Licence tiers, the number of developers, users or installations covered, and what each tier includes are described on each product page.
2.2 Prices are shown in US dollars unless stated otherwise and exclude any sales tax or VAT, which FastSpring calculates at checkout according to your location and status. FastSpring may display prices in other currencies.
2.3 Every licence includes twelve (12) months of updates and email support (the “Maintenance Period”). You may renew maintenance at the renewal price shown on the product page at the time of renewal.
2.4 We may change prices at any time. Price changes do not affect orders already accepted.
2.5 Business customers can request a formal quotation, pay by invoice or purchase order where FastSpring supports it, and ask about source-code escrow for site licences by contacting us.
3. Free trials
3.1 Every Bastion product is available as a free 30-day trial before purchase, so that you can confirm it meets your requirements. Any functional limits of a trial are listed on our Trial Downloads page.
3.2 Trials are for evaluation only and must not be used in production or distributed.
4. Delivery
4.1 Products are delivered electronically. After your order is accepted, your licence key is shown on the order confirmation page and sent to the email address you provided at checkout. The software itself is downloaded from our Website.
4.2 If you do not receive your licence key within one hour of ordering, check your spam folder and then contact support@bastionsoftwaresolutions.com.
5. Refunds
Our Refund Policy explains when refunds are available. In summary: because every product can be fully evaluated free of charge before purchase, sales are final, except where a severe defect cannot be fixed within 30 days, or where the law gives you a right to a refund.
6. Support
Support is provided by email to licensees during their Maintenance Period at support@bastionsoftwaresolutions.com. We aim to respond within two (2) UK business days.
7. Using the Website
7.1 You may view and download material from the Website for your own information and for evaluating our products. You must not use the Website in a way that is unlawful or fraudulent, that damages or impairs its availability, or that attempts to gain unauthorised access to it or to our systems.
7.2 Content on the Website is provided for general information. We take care to keep it accurate but do not guarantee that it is complete or up to date. Product specifications and code samples may change between releases.
7.3 The Website may link to third-party websites. We are not responsible for their content or practices.
7.4 “Bastion”, “BastionMFT”, “PstUnity” and other product names and logos are trade names of Bastion Software Solutions Ltd. All other trademarks belong to their respective owners, and their use does not imply endorsement.
8. Liability
8.1 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
8.2 Our liability in relation to the software is set out in the Software Licence Agreement. Subject to clause 8.1, we are not liable for any loss arising from your use of the Website.
9. Consumers
If you buy as a consumer, you have legal rights in relation to digital content that is faulty or not as described. Nothing in these terms affects those rights. Any right to cancel your order is set out in FastSpring’s Terms of Sale.
10. Privacy
We handle personal data as described in our Privacy Policy.
11. Changes
We may update these terms from time to time. The version shown on the Website when you place an order applies to that order.
12. Law
These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in your local courts.
